Turn 5 Social Media Sweepstakes Official Rules

Please read these Official Rules in full before entering this Turn 5 Social Media Sweepstakes (the “Sweepstakes”). These Official Rules shall govern the Sweepstakes in the event of any inconsistency with other Sweepstakes related materials.

• No Purchase Necessary: No purchase necessary to enter or win. A purchase or payment will not increase your chances of winning. The Sweepstakes are void where prohibited.
• Sponsor: Turn 5 Inc., a Pennsylvania corporation, located at 7 Lee Boulevard, Malvern, PA 19355 (“Sponsor”).
• Eligibility: The Sweepstakes is open to legal residents of the fifty (50) United States and the District of Columbia, and Canada, who are 18 years or older at the time of entry. Officers, directors, and employees of Sponsor, members of these persons’ immediate families (including spouses, parents, children, siblings and their spouses), and persons living in the same households as such persons (whether or not related thereto) are ineligible to enter this promotion. Participation in the Sweepstakes constitutes a participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes.
• Prize: One (1) eligible winner will receive the prize as described in the social media post (the “Prize”). The retail value of the prize is less than $500. The Prize is non-transferable to any other person, including relatives or friends. Winner is solely responsible for all applicable federal, state and local taxes and any expenses associated with the Prize, unless otherwise indicated. No substitution, cash equivalent or transfer of the Prize is permitted except at Sponsor’s sole option for a prize of comparable value.
• How to Enter: Participants enter the Sweepstakes pursuant to the procedure in the social media post. Limit one (1) entry per account. The Sweepstakes is in no way sponsored, endorsed or administered by, or associated with the “Social Media Platform” (Facebook, Twitter, Instagram, and/or YouTube). By agreeing to these Official Rules, participants hereby release the Social Media Platform, its employees, officers and directors from any and all liability relating to the Sweepstakes.
• Contest Term: The contest term shall be as described in the social media post.
• Winner Selection: One (1) winner will be chosen at random from the eligible entries on or around the date listed in the social media post. The odds of winning the Prize depend on the number of eligible entries received for the drawing. The winner that is chosen will be notified by direct message on the Social Media Platform within forty-eight (48) hours of selection by Sponsor. The winner must respond to the direct message within seventy-two (72) hours of receipt. Winner must then provide Sponsor with full contact details in order to be awarded the Prize. Winner may also be required to complete, execute and return an Affidavit of Eligibility and Release at the discretion of Sponsor and within the timeframe stated by Sponsor. Failure to comply with these Official Rules will make a participant ineligible to participate in the Sweepstakes or to win the Prize and will cause the Prize to be forfeited and, at Sponsor’s sole discretion, awarded to an alternate winner. If (i) the winner does not respond to prize notification within the timeframe stated, (ii) the winner declines his or her prize, or (iii) the winner fails to return any required documents within the timeframe stated, it will result in the disqualification of such potential winner and an alternate potential winner may be selected by random drawing at Sponsor’s sole discretion.

• Privacy: Any personal information received by Sponsor in connection with the Sweepstakes will be used solely in accordance with the Privacy Policy set forth at Extreme Terrain’s official site, which can be found at: https://www.extremeterrain.com/ordering.html#Privacy_Policy
• Miscellaneous: By entering, participant agrees to follow the Official Rules and hold harmless and indemnify the Sponsor against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (a) participant’s participation in the Sweepstakes; or (b) the receipt or use/misuse of the Prize awarded in the Sweepstakes. The Sponsor is not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, illegible, undelivered or garbled entries or email; or for entries not received due to lost, failed, delayed or interrupted connections, including Internet Service Provider, web-server, network, cable, server, satellite, phone-line connections or miscommunications, or other electronic malfunctions, computer or telephone, hardware or software failures, malfunctions, or garbled or jumbled transmissions. The Sponsor is also not responsible for any errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the winner or the prize, or in any Sweepstakes-related materials. The Sponsor is also not responsible for injury or damage to participants’ or to any other person’s computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or the website or who are in violation of these Official Rules, as determined solely by Sponsor, will be disqualified and all associated entries will be void. Sponsor reserves the right, in Sponsor’s sole discretions, to cancel or suspend the Sweepstakes should virus, bugs, unauthorized human intervention, or other cause, in Sponsor’s sole opinion, corrupt or impair the administration, security, fairness or proper operation of the Sweepstakes, and in the event of termination, Sponsor may select the Winner from all non-suspect eligible entries received prior to action so taken. Participants agree that the Sponsor will have no liability whatsoever for and shall be held harmless by participants against, any and all injuries, losses or damages of any kind, including death, to persons, or property incurred in connection with or resulting, in whole or in part, directly or indirectly from participation in the Sweepstakes and/or acceptance, possession or use/misuse of any prize awarded. Sponsor reserves the right to correct any and all printing, typographical or mechanical errors.
• Governing Law and Forum Selection: By entering this Sweepstakes, participant agrees that (a) any and all disputes, claims and causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (C) under no circumstances will any participant be permitted to obtain awards for, and each participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of- pocket expenses, and any and all rights to have damages multiplied or otherwise increased. These Official Rules and the Sweepstakes are governed by and controlled by the laws in and of the Commonwealth of Pennsylvania, applicable to contracts made and performed therein without reference to the applicable choice of law provisions. All actions, proceedings or litigation relating hereto will be instituted and prosecuted solely within Philadelphia, Pennsylvania. The participant hereby consents to the jurisdiction of the federal and state courts of Pennsylvania with respect to any action, dispute or other matter pertaining to or arising out of the Sweepstakes including, without limitation, any prize awarded in connection with the Sweepstakes, and waives every defense that such jurisdiction is inconvenient or improper.
