XT CASH REWARDS TERMS

These XT Cash Reward Terms (“Terms”) were last updated June 30, 2025.

Please review these Terms carefully for the Military and First Responders XT Cash Rewards Program (the “Program”).

Turn5, Inc. (“Turn5,” “we,” or “us”) provides this Program, subject to your agreement to, and compliance with, these Terms. These Terms are incorporated by reference into the Terms of Use, available at https://www.extremeterrain.com/terms-of-use.html.

You (“purchaser”) acknowledge and agree that your choice to participate in the Program is optional. Turn5 may revoke, modify or discontinue all or any portion of the Program at any time in Turn5’s sole discretion, with or without notice to you.

You understand and agree that your continued participation in the Program indicates your acceptance of these Terms. You can terminate your participation in the Program by ceasing to make purchases through your individual account on the Domain governed by these Terms.

XT Cash Rewards Program

The Program provides certain cash rewards (“XT Cash Rewards”) to consumers through www.ExtremeTerrain.com (the “Domain”):

XT Cash Rewards equal 5%, 10%, or 20%, as applicable, of the Purchase Price for purchases made through the Domain or via telephone. For purposes of earning XT Cash Rewards, “Purchase Price” is the price paid for goods after any coupons or discounts are applied, before shipping, fees, or taxes. Purchases of gift cards do not earn XT Cash Rewards.

XT Cash Rewards may be redeemed on the next purchase made through the Domain or via the phone, or XT Cash Rewards may be accumulated, subject the expiration terms set forth herein. XT Cash Rewards will be redeemed and applied to the Purchase Price during the checkout process.

XT Cash Rewards are not a credit, debit or gift card. Rewards have no cash value and are not eligible for cash back. Rewards are non-transferable to any other person or entity, nor are they eligible for use with any other merchant. Rewards are not eligible to be purchased separately.

Eligibility

The Program is open to individual residents in the continental U.S. (excluding Guam, Puerto Rico, U.S. Virgin Islands and territories) who are 18 years or older and who have been successfully verified as active first responders, Veterans, or active members of the military.  We will verify status through our third-party provider, SheerID.

Earning Rewards

Purchases made through the Program earn 5% XT Cash Rewards on brands not owned by us or our affiliates, earn 10% XT Cash Reward for brands owned by us or certain of our affiliates, or earn 20% XT Cash Rewards for Open Box. XT Cash Rewards will be issued to your account via a promotional balance within 24 hours of shipment of the qualifying item.

Expiration

XT Cash Rewards expire 90 days from the date of issuance.

Returns

•  If a purchase earned XT Cash Rewards, and such purchase is returned, Turn5 will remove the earned XT Cash Reward from the purchaser’s Program account.
• If a purchase was made using XT Cash Rewards, and such purchase is returned in compliance with the terms of sale, Turn5 will add the earned XT Cash Rewards back to the purchaser’s Program account. Such credited XT Cash Rewards will expire on the original expiration date. In the event such expiration date has already passed, purchaser will have no less than 1 month from the credit date before final expiration of such reward.
• If a purchase earned XT Cash Rewards, and the purchase is returned after such XT Cash Rewards were redeemed, the refund amount for such purchase will be reduced by the amount of redeemed XT Cash Rewards.

o   For example, if the Purchase Price of Order A is $100, the purchaser earns $10 in XT Cash Rewards. If those XT Cash Rewards are used on a subsequent purchase and then Order A is returned, the refund amount for Order A will be $90.

Turn5 may remove XT Cash Rewards from a purchaser’s account and/or suspend access to the Program, in its sole discretion, if it is determined that a purchaser is attempting to use the return system to fraudulently earn XT Cash Rewards or abusing the Program.

Disputes

Any dispute related to, or arising from, the Program shall be resolved by final and binding arbitration instead of through courts of general jurisdiction or through class action. Participants in the Program waive the right to participate in any class action claims.

DISCLAIMER AND LIABILITY.

THE PROGRAM IS PROVIDED ON A STRICTLY “AS-IS” AND “AS AVAILABLE” BASIS. TURN5 DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES REGARDING THE PROGRAM OR THE AT CASH REWARDS, WHETHER EXPRESS, IMPLIED OR STATUTORY, AND EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. YOU ACKNOWLEDGE AND AGREE THAT YOUR PARTICIPATION IN THE PROGRAM IS VOLUNTARY AND AS SUCH, TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TURN5, OUR OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, SUBSIDIARIES, PARENTS, JOINT VENTURES, SUCCESSORS AND ANY OTHER COMPANIES UNDER COMMON CONTROL WITH US, OR ANY INDEPENDENT CONTRACTORS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT OR INDIRECT DAMAGES, LOST PROFITS OR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES ARISING FROM OR IN ANY WAY RELATED TO YOUR RELATIONSHIP WITH TURN5, INCLUDING YOUR PARTICIPATION IN THE PROGRAM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. WE DO NOT WARRANT THAT YOUR USE OF THIS SITE OR PARTICIPATION IN THE PROGRAM WILL BE UNINTERRUPTED, SECURE, OR ERROR FREE. PARTICIPATION IN THE PROGRAM IS AT YOUR SOLE DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGES AND/OR LOSSES RESULTING THEREFROM. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY DAMAGES ARISING FROM OR IN ANY WAY RELATED TO THE PROGRAM, WILL AT ALL TIMES BE LIMITED TO THE PURCHASE PRICE AMOUNT PAID TO TURN5 FOR THE PURCHASE GIVING RISE TO THE CLAIM.  TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND TURN5 AGREE THAT ANY CLAIM BETWEEN US MUST BE BROUGHT WITHIN ONE (1) YEAR OF THE DATE THAT THE CLAIM AROSE.

SOME JURISDICTIONS, INCLUDING NEW JERSEY, DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OF CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU AND YOU MAY ALSO HAVE OTHER LEGAL RIGHTS THAT VARY FROM JURISDICTION TO JURISDICTION.
